Skyland Travel Inc. (Escapes.ca) Terms and Conditions

It is the responsibility of the user to read and accept the Skyland Travel Inc. (Escapes.ca) Terms and Conditions before purchasing travel services through the Escapes.ca website.

It is also the responsibility of the user to read the terms and conditions of the travel supplier with which they are purchasing travel services from. The terms and conditions of the travel supplier are made available during the booking process.

Escapes.ca is a website owned by Skyland Travel Inc. These Terms and Conditions are applicable to all users of the website. By using this website you agree solely, without modification, to the terms and conditions listed below and, if making a travel reservation, to the terms and conditions of the respective travel supplier. Users of the Escapes.ca website shall be referred to as “user” and “customer” in these Terms and Conditions.

Responsibility

Skyland Travel Inc., hereby known in these terms and conditions as “Escapes.ca”, “we”, “us”, and “our”, has the same responsibilities as a travel agency, as such, we offer the service of providing travel information and facilitating reservations which are provided by various third party travel suppliers, to the customer.

You, the customer, must be at least 18 years of age in order to use and purchase travel services from Escapes.ca. Users of this website must agree to all of the terms and conditions listed on this page in order to use this website.

PRICING AND CONTENT

All prices within this website are in Canadian dollars unless otherwise stated. Airport fees, where applicable, are not included in the pricing. All prices on this website are subject to change without prior notice. Any changes in pricing that may occur before, during or after a purchase, as a result of a tour operator and/or airline change, are not the responsibility of Escapes.ca. Once a booking is complete, pricing CANNOT be adjusted.

Pricing and availability on all packages and flights is not guaranteed until the reservation has been completed. Any prices quoted are not guaranteed and are subject to change at anytime, even during the booking process. Should there be a discrepancy between the price shown on the website and that of the actual travel supplier price, the later shall prevail.

Important: If the price of a product is displayed incorrectly and subsequently reserved by a user, Escapes.ca and the travel supplier reserve the right to cancel the reservation at the incorrect price within 48 hours of the booking being made. A refund of payments made will be processed immediately and returned via the form that the original payment was made.

All products are subject to availability and deliverable within Canada only. All informational content, such as hotel and destination information, on this website is provided only as a guideline and may not be an exact representation. We are aware that the customer is in demand of accurate information and as a result makes every effort possible to make sure that the content within this website is up-to-date. However, due to constant changes and occasional circumstances beyond our control, some of the hotel and destination information within this website may not be 100% accurate.

We endeavour to make sure that any images and photos on this website are as close a representation as possible but we cannot be held responsible for changes beyond our control or any inaccuracies related to any imagery. Hotel and destination images on this website are representational only and cannot be guaranteed completely accurate.

Any hotel star ratings within this website are the opinion of Escapes.ca and may be different than the hotel ratings of the various travel suppliers offered on our website. Hotel star ratings are a subjective way to categorize a property based on their facility and service levels, hotel ratings vary via the source publishing them and users should seek multiple sources to gather the most accurate information. Users should not rely on a single source for any hotel information, including hotel star ratings.

Our “Best Price Guarantee” applies only to vacation packages sold through Canadian travel suppliers which are offered on our website. Escapes.ca will match any genuine price quote provided the price is not below cost. While Escapes.ca will make every attempt to provide the lowest pricing, occasionally circumstances beyond our control may prevent us from providing the lowest price. These circumstances may include but are not limited to group pricing, blocked space pricing, at source discounts, exclusive price agreements and errors made by other companies. We reverse the right to request a written price quote on any fare that is being matched.

Important: When a user makes a reservation, the prices on that reservation are locked in at the time it is made. Travel suppliers will not allow any adjustments in pricing to be made after a reservation is completed and as such, Escapes.ca, cannot make any amendments or changes to a reservations price after it is completed.

PAYMENTS

Payment for a booking is required at the time a reservation is made. Purchases can be made using Visa, MasterCard, or American Express credit cards. Depending on how far in advance a reservation is made, payment can be done via deposit or can be paid in full. If a user is paying via deposit, it is the users responsibility to ensure that their reservation is paid in full before the final payment due date. Any reservations that are not paid in full before the final payment due date, will be cancelled immediately to avoid any penalties to Escapes.ca that may be incurred by the travel supplier. If applicable, final payment due date is made available on the users travel confirmation email.

Credit card authorization checks may be required depending on the details of a reservation. This may include, but is not limited to, reservations made with a third party credit card, last minute departures, non-matching payment details. We reserve the right to request a credit card authorization for any reason we deem necessary. A credit card authorization is sent via a secure web form in which the credit card holder mush upload a photo of their picture ID, their credit and a selfie to prove that it is them authorizing the purchase. The information submitted via our credit card authorization form is stored securely and is encrypted to protect user data. This information is permanently deleted once the information is deemed by Escapes.ca to be no longer needed.

All fraudulent purchase will be investigated and pursued legally.

CONFIRMATION AND DELIVERY

After an online purchase is made, the customer will receive an automatic email confirming their purchase. This email will contain a copy of all the information that the customer entered to complete the reservation, such as passenger names and contact information. This email confirmation acts as a proof of purchase and invoice from Escapes.ca. It is the responsibility of the customer to verify that ALL the information on the confirmation email is accurate and in accordance with the travel product that they have purchased. Any changes required due to the customer entering incorrect information, such as name spelling mistakes, or due to the customer booking the wrong product will result in additional fees. These fees may be charged by the travel supplier and/or Escapes.ca.

Depending on the rules of the travel supplier, some travel reservations may be 100% non-refundable and non-changeable immediately upon completion of the reservation. Because of this, users should ensure that they are strongly committed to their travel plans before completing a reservation. They should also ensure that they have travel insurance to protect against any unforeseen circumstances.

FLIGHT TIMES AND CONFIRMATION

Airline flight schedules are subject to change as per travel supplier terms and conditions. Flight schedule changes are beyond the control of Escapes.ca and as such, we cannot be held responsible for any missed flights or disrupted travel plans due to an airline flight schedule change. In the event of a flight schedule change, if notified by the airline, we will send a flight schedule change notice to the customer. Customers should reconfirm their flight times at least 24 hours prior to departure to ensure that no last minute flight changes have occurred. Airline contact telephone numbers are included on travel documentation that is provided to the user before departure.

AIRPORT CHECK-IN

It is strongly recommended that all passengers provide themselves with enough time to check-in and to pass through airport security and customs (if applicable). Check-in counters will generally close 1 hour prior to departure. Any passengers attempting to check-in after the check-in process has closed, will be denied boarding and will not be provided any refund. It is recommended that customers check-in to their flights online via the airline website. Online check-in usually commences 24 hours prior to departure.

Customers should check their flight itinerary for departure airport and terminal information. Customers should also reconfirm flight times between 24-12 hours prior to departure. Information to reconfirm flights can be found on the travel documentation that is provided prior to departure or via the departure city airport website.

HOTEL DURATION

If traveling on a vacation package, the duration is determined by the flight times, however in some cases, flight times may not align conveniently with hotel check-in and check-out times. Typically hotel check-in time is 3pm and check out time is 12 noon. Some flights may arrive at a very early time (ie 5am) of the day and hotel check-in time may not commence until around 3pm. Additionally, while some flights may depart after midnight, hotel check out time may still be at 12 noon of the previous day. Users should carefully review flight times and hotel dates before completing a travel reservation.

TICKET DELIVERY

The majority of travel tickets and hotel vouchers are now in the form of electronic tickets, known as edocuments, etickets or travel documents. Travel documents will be emailed to the email address provided by the customer at time of booking. It is the responsibility of the customer to ensure that any emails received from Escapes.ca do not get deleted or directed to spam filters or junk folders. Customers should amend their email settings to ensure that emails from Escapes.ca are delivered correctly to their email program. Escapes.ca is not responsible for any problems or miscommunications that may arise due to email delivery failures.

We typically receive travel documents from the travel supplier 2-3 weeks before departure. Once they are received by us, they will be processed and then sent to the customer via our automated email system. Any last minute bookings within 2 weeks will have their travel documents sent to them as soon as they become available.

DOCUMENTATION

It is the responsibility of the customer to ensure that all the necessary documents, such as passports and visas, required to gain entry into the country of destination are had by all passengers on the reservation. It is also the responsibility of the customer to ensure that all travel documentation is in legible and adequate form to process documents. Escapes.ca is not responsible for any customers who are denied boarding due to improper or inadequate documentation. Obtaining passports and visas may require lengthy processing times, it is the responsibility of the customer to ensure that all required documentation is received before travel departure.

IMPORTANT – Children 18 and under traveling alone or with only one parent or guardian must have a notarized letter of authorization signed by the parent or guardian who is not traveling or if both parents are not traveling with the child, this note must be signed by both parents. This rule currently applies for, but is not limited to, travel to the United States, Mexico, and the Dominican Republic.

CANCELLATION

Flight reservations may be 100% non-refundable. Depending on the airline, many flights are 100% non-refundable once the reservation is made. If not 100% non-refundable, they may have cancellation fees of varying amounts. If you have questions regarding cancellation policies of a specific airline, please clarify these details before making your reservation. Once a reservation is made it is bound by the terms and conditions of the airline.

Vacation package reservations departing within 45 days are 100% non-refundable. Any changes required due to errors made at the time of reservation may incur fees of varying amounts depending on the travel supplier. These details can be found in the terms and condition of the applicable travel supplier when making the reservation. Users can also speak with a travel consultant to gather more information about cancellation and change fees prior to making their reservation. It is highly recommended that customers purchase travel insurance or travel supplier waivers in order to protect themselves against the loss of their purchase due to unforeseen circumstances.

Cancellation of vacation packages departing within 45 days will not be refunded, unless the user has purchased travel insurance and/or a travel supplier waiver. Travel insurance and travel supplier waivers have strict rules governing them and users must ensure that they understand these rules when purchasing travel insurance or travel supplier waivers. It is recommend that user speak with a travel consultant if they have questions or are unclear about any cancellation and travel insurance and waiver details.

TRAVEL INSURANCE AND WAIVERS

During the booking process, users are given the option to purchase travel insurance and/or a travel supplier waiver. These insurances and waivers are in place to protect the customer against any unforeseen circumstances that may occur prior to, during or after your trip. There are different types of insurance and waiver packages available and the purchase of these is an optional decision to the customer.

In the event of an unforeseen circumstance, if no protection is had by the user, they may risk losing 100% of their travel reservation purchase. Travel supplier terms and conditions are very strict and no exceptions will be made, regardless of how unfortunate a unforeseen circumstance may be. Because of this, we highly recommends customers have some form of coverage to protect against unforeseen circumstances or be prepared to potentially lose 100% of the travel reservation purchase.

Travel insurance can be purchased up to 48 hours after a reservation has been made, with the exception of medical only travel insurance, which may be purchased anytime up until departure.

Travel supplier waivers must be purchased at the time the reservation is made.

It is the customers responsibility to read and familiarize themselves with the travel insurance and travel supplier waivers, to understand what their purchased travel insurance/waiver covers and under what conditions. If the customer wants to make an insurance claim it is their responsibility to contact Escapes.ca as soon as possible. Please contact us if you require more information regarding travel insurance or travel supplier waivers.

OTHER IMPORTANT INFORMATION

As a seller of various travel products, from various travel suppliers to various travel destinations, Escapes.ca cannot control or be held responsible for the numerous circumstances that can be related to each travel reservation. By making a reservation with Escapes.ca, the user takes on certain responsibilities and risks associated with the travel reservation. These may include, but are not limited to the following:

Hotels and Resorts – Hotel and resort standards are subjective and can change without notice. While we make all efforts to provide adequate and up to date information on the hotels and resorts we offer, we cannot be held responsible for any issues or inadequacies that may arise at a hotel or resort. Hotels and resorts in some destinations may experience water and power interruptions. If a customer has an issue with a hotel or resort upon their arrival, they must inform us or the travel supplier immediately, so that proper procedures can be made to try and rectify the issue(s).

Room Allocation – Hotels and resorts are responsible for room allocation within the category reserved. Escapes.ca assumes not responsibility and has no control as to what room is allocated to the customer. While we are able to enter in certain hotel room requests, the user understands that these request are not guaranteed and are based on the hotels decision and availability upon check in. If a customer would like to change room, they must request to change this with the hotel and it may be subject to additional fees.

Food, Water and Beverages – Food, water and beverages may be different in other countries, additionally, a change in routine such over indulgence and too much sun, may lead to health issues or illness. Customers are required to take precaution to prevent situation like these. Customers should also gather multiple points of data on hotels to ensure they are staying at a resort that provides quality facilities and services that may help to reduce health and illness issues. Escapes.ca assumes no responsibility for any issues that may arise at hotels and resorts relating to health and illness issues.

Sports and Activities – Many hotels and resorts offer activities, organized sports and sport equipment as part of their services. Some of these sports and activities may involve risks. Escapes.ca is not responsible for any risks, injury or damages that may result from these sports and activities.

Insects and diseases – Different countries present different types of insects and diseases. Tropical foreign countries can be more likely to have more insects and diseases. Insects do not differentiate between hotels and can be found anywhere. Customer are encouraged to take necessary precautions against any potential risks that may arise when traveling to a different country.

Beaches – Beaches can change in size and condition over time and throughout the year due to various environmental factors, because of this and as with any photo on this website, the accuracy of photos cannot be guaranteed and is subject to change. Customer should consult multiple sources of information to ensure the most up to date information is obtained.

OWNERSHIP

All the contents within this website are the property of Escapes.ca and/or its third party suppliers. This website is intended for personal use only and is not to be used for commercial purposes. None of the content found on this website may be reproduced, republished, displayed, distributed, modified, sold, or transferred without the written consent of Escapes.ca.

This website is to be used to gather information on travel-related goods and service and to make legitimate purchases and/or reservations. This website may not be used to make any false, fraudulent, or speculative purchases and/or reservations.

JURISDICTION AND LEGALITY

The Escapes.ca website is controlled from the Skyland Travel Inc. office in Vancouver, British Columbia. All purchases on the Escapes.ca website are processed according to British Columbia regulations. Skyland Travel Inc. is a registered travel supplier under the BC Travel Registry number 2143-1.

Escapes.ca does not divulge customer information to third parties, however, we may do so if required to by government or law enforcement authorities, court order, or to protect the rights and/or properties of Escapes.ca and Skyland Travel Inc.

THIRD PARTY SUPPLIERS

All travel packages, flights and hotels displayed on this website are supplied to Escapes.ca (Skyland Travel Inc.) by various third party suppliers (travel suppliers) and in turn are subject to their own terms and conditions. Escapes.ca is a seller for the third party suppliers and is in no way responsible for incidents brought upon or caused by any of the third party suppliers.

When the customer purchases travel services through Escapes.ca they must refer to the appropriate third party suppliers terms and conditions. It is the responsibility of the customer to refer to the appropriate third party supplier for the terms and conditions that are specific to their travel services.

Escapes.ca (Skyland Travel Inc.) cannot be held liable for any loss, damage or injury of any nature whatsoever whether to person or property that may arise from the purchase of any travel services through this website. By purchasing travel services through this website you, the customer, hereby understand and agree without modification to the terms and conditions listed above.
